Welcome to DMEHelper. By accessing or using DMEHelper (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. About DMEHelper
DMEHelper is an informational directory of Durable Medical Equipment (DME) suppliers that accept Medicare. We aggregate publicly available data from the National Plan and Provider Enumeration System (NPPES) and related sources to help patients, caregivers, and healthcare professionals locate Medicare-approved DME providers.
2. Informational Purpose Only
DMEHelper is not a medical service, medical advice platform, or healthcare provider. Nothing on this site constitutes medical advice, diagnosis, treatment, or a recommendation to use any specific supplier. Always consult your physician, licensed healthcare provider, or Medicare directly for medical decisions.
Medicare coverage and supplier participation status can change. Verify provider eligibility and your specific coverage with your Medicare plan before making any decisions.
3. No Endorsement of Listed Providers
DMEHelper does not endorse, recommend, or guarantee any specific DME supplier. Listing in our directory does not indicate approval, certification, or vetting by DMEHelper beyond what is reflected in publicly available Medicare data. Provider information may be incomplete or out of date. Always conduct your own due diligence.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You agree NOT to:
- Scrape, harvest, or systematically download provider data for commercial redistribution
- Use automated tools (bots, crawlers) to extract directory data beyond normal browsing
- Misrepresent your identity or affiliation when submitting a provider claim or contact form
- Submit false, misleading, or defamatory reviews or content
- Interfere with or attempt to disrupt the Service's technical infrastructure
- Use the Service in connection with any illegal activity, including Medicare fraud
5. Provider Listings & Claims
DME suppliers may claim and update their listing through our provider portal. By submitting a claim, you represent that you are an authorized representative of the listed business. DMEHelper reserves the right to verify, reject, or remove any claimed listing at its sole discretion.
User-generated content submitted through claims, reviews, or forms becomes the property of DMEHelper and may be displayed publicly. You grant DMEHelper a non-exclusive, royalty-free, worldwide license to use such content.
6. Intellectual Property
All content on DMEHelper โ including text, design, graphics, logos, software, and the compilation of provider data โ is the property of DMEHelper or its data providers and is protected by applicable copyright and trademark law. NPPES data is publicly available and sourced from CMS.
You may not reproduce, distribute, or create derivative works without written permission, except as expressly permitted for personal, non-commercial use.
7. Third-Party Links & Services
The Service may link to third-party websites or services (e.g., Medicare.gov, provider websites). We are not responsible for the content, privacy practices, or availability of those sites. Accessing third-party sites is at your own risk.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DMEHELPER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability for any claim related to the Service shall not exceed $100 USD.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT PROVIDER DATA IS ACCURATE, COMPLETE, OR CURRENT.
10. Account Termination
We reserve the right to suspend or terminate access to the Service (including provider portal accounts) at any time, without notice, for violation of these Terms or for any other reason at our sole discretion.
11. Changes to These Terms
We may update these Terms periodically. We will update the "Effective" date above. Continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict of law principles. Any disputes shall be resolved exclusively in courts located in New Jersey.
